Terms of Service

1. Acceptance of Terms

By accessing or using the SuperNest platform, mobile application, and related services (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

SuperNest provides a hospitality operating system for short-term rental hosts, guests, cleaners, superhosts, and operations teams. The Service includes AI-powered communication tools, property management features, guest experience tools, cleaner workflows, invite handoff, proof capture, ops console surfaces, and related services.

3. User Accounts

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must immediately notify us of any unauthorized use of your account
  • You may not share your account with others or create multiple accounts

4. Host Responsibilities

As a host using SuperNest, you agree to:

  • Provide accurate and up-to-date property information
  • Ensure your property complies with all applicable laws and regulations
  • Review AI-generated communications as configured in your settings
  • Respond to escalated guest issues in a timely manner
  • Maintain the safety and habitability of your property

5. Guest Usage

As a guest using SuperNest, you agree to:

  • Use the Service only in connection with legitimate stay reservations
  • Respect property rules and guidelines provided through the app
  • Use the AI concierge and SuperHost features responsibly
  • Not share access codes or sensitive property information with unauthorized parties

6. AI Services

SuperNest uses artificial intelligence to assist with guest communication and recommendations. You acknowledge that:

  • AI-generated responses are based on the property knowledge base and may not always be perfectly accurate
  • Hosts are ultimately responsible for the accuracy of information provided to guests
  • AI services are provided “as is” and may be updated or modified at any time
  • SuperNest is not liable for actions taken based on AI-generated recommendations

7. Subscription and Payment

  • Paid plans are billed monthly or annually as selected
  • Prices may change with 30 days' written notice
  • Guest paid service requests and partner purchases may be processed separately from host subscriptions
  • Refunds for host subscriptions, guest paid requests, and partner offers are handled according to the applicable checkout, refund policy, and service recovery context
  • Failure to pay may result in service suspension

8. Guest Paid Requests and Partner Offers

Hosts may configure optional paid guest requests, such as early check-in, late checkout, or extra items. SuperNest may also show partner offers with referral or commission attribution. Service quality comes first: paid offers may be paused or suppressed during active incidents, unresolved access issues, safety concerns, refund requests, or other service recovery situations.

9. Intellectual Property

The Service, including its design, features, and content, is owned by SuperNest and protected by intellectual property laws. You retain ownership of content you submit but grant SuperNest a license to use it to provide the Service.

10. Prohibited Conduct

You may not:

  • Use the Service for any illegal purpose
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to send spam, phishing, or other unsolicited communications
  • Scrape, crawl, or otherwise extract data from the Service without permission
  • Impersonate another person or entity

11. Limitation of Liability

To the maximum extent permitted by law, SuperNest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to SuperNest in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
